Identification of project stakeholders, formation of special purpose vehicles, if necessary, taking into account the various forms of participation under company law, development of a suitable contract award and contract model
- Public procurement and contract law
Structuring and implementation of the public procurement procedure including preparation of the notice together with the suitability and award criteria, drafting and negotiation of necessary contractual documents, support in preparation of other public procurement documents such as the output-specific performance specification etc., support in ongoing documentation of the procedure
- Public law, budget and municipal law
Clarification of the public law boundary conditions and the budget law concerns of the project
- Subsidy law, state aid law
Co-ordination of subsidy and state aid law framework conditions for successful or necessary project applications and pre-notification discussions with the European Commission and for the avoidance risks of invalidity and claims for return of the subsidy or aid
- Labour and tax law and insolvency precautions
Consideration of tax and labour law issues (socially acceptable personnel concepts), mitigation of the insolvency risk, for example, through step-in clauses
